By accessing or using Ataiva ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Ataiva is an AI brand visibility tracking platform. We query AI engines on your behalf, analyze responses, and provide visibility reports and recommendations. We use official, documented APIs from AI providers.

3. Account Responsibilities

• You must provide accurate account information
• You are responsible for maintaining the security of your account credentials and API keys
• You must not share your account with unauthorized users
• You must not use the Service for any illegal purpose

4. Acceptable Use

You agree not to:

• Scrape, crawl, or automatically extract data from the Service beyond the provided API
• Redistribute data obtained from the Service without authorization
• Attempt to circumvent rate limits or access controls
• Use the Service to harm, defame, or harass any person or brand

5. Subscriptions and Billing

Paid subscriptions are billed monthly or annually through Paddle, our Merchant of Record. Paddle handles all payment processing, tax collection, and invoicing. By subscribing, you also agree to Paddle's Terms.

7. Data Accuracy

AI engine responses change frequently and may contain inaccuracies. Ataiva reports what AI engines say; we do not guarantee the accuracy of AI-generated content. Visibility scores are calculated based on our methodology and should be used as directional indicators, not absolute measures.

8. Intellectual Property

The Service, including its design, code, and documentation, is owned by Ataiva. Data you input (brand names, keywords) remains yours. AI visibility data generated by the Service is licensed to you for your internal use only.

9. Limitation of Liability

Ataiva is provided "as is" without warranty. We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability is limited to the amount you paid in the 12 months preceding the claim.

10. Termination

You may cancel your account at any time. We may terminate accounts that violate these terms. Upon termination, your data will be deleted within 30 days.

11. Changes to Terms

We may update these terms. Material changes will be communicated via email. Continued use after changes constitutes acceptance.
